There could be a whole new type of employment lawsuit looming over the horizon. Legislation has been introduced in several states that would allow employees to sue who have been subject to bullying, demeaning behavior, yelling at, or otherwise abused by their managers. Such bullying or other jerk-like behavior often is not illegal or discriminatory. It may be just plain mean, threatening or disgusting. Employee surveys have indicated that many in the workplace report that they have been subject to bullying. Organizations are beginning to respond by creating anti-bullying policies and training. But should it be illegal to be a jerk? Would lawsuits address the problem or simply create a plague of lawsuits? Just when would someone cross the line between being a “common jerk” to an “illegal jerk” who could be sued for damages?
