The Equal Employment Opportunity Commission (EEOC) has set its 2007 enforcement priorities. Employers should pay particular attention to two of these priorities. First, the EEOC says it will place a greater focus on race discrimination claims. Incoming Chair Naomi Earp has stated numerous times that she is surprised that there are not as many cause findings (for employees) coming out of certain EEOC offices as she thought there would be. Watch for these EEOC offices to now issue more cause findings. Second, the EEOC has decided to focus on alleged systemic discrimination and major class action litigation. This will include EEOC efforts to broaden individual investigations starting in one EEOC office to include other offices located where the involved employer also has workers. Watch out for EEOC inquiries in individual cases asking for information in other offices/locations.
